1. Introduction

In the following, we inform about the processing of personal data when using

  • our website www.raus.life
  • our profiles in social media.

According to Art. 4 No. 1 DSGVO, personal data are all data that can be related to a specific natural person, e.g. their name or IP address.

1.1. Contact details of the responsible party

1.2. General information on data processing

1.2.1. Scope of the processing of personal data

As a matter of principle, we process personal data of our users only to the extent that this is necessary to provide a functional website and our content and services. The processing of personal data of our users is regularly carried out only with the consent of the user. An exception applies in those cases where obtaining prior consent is not possible for actual reasons and the processing of the data is permitted by legal regulations.

1.2.2. Legal basis for the processing of personal data

  • Art. 6 para. 1 p. 1 it. a DSGVO serves as our legal basis for processing operations for which we obtain consent.
  • Art. 6 para. 1 p. 1 lit. b DS GVO is the legal basis insofar as the processing of personal data is necessary for the performance of a contract, e.g. if a site visitor purchases a product from us or we perform a service for him. This legal basis also applies to processing that is necessary for pre-contractual measures, such as in the case of inquiries about our products or services.
  • Art. 6 (1) p. 1 lit. c DSGVO applies if we fulfill a legal obligation by processing personal data, as may be the case, for example, in tax law.
  • Art. 6 para. 1 p. 1 lit. f DSGVO serves as the legal basis when we can rely on legitimate interests to process personal data, e.g. for cookies that are necessary for the technical operation of our website.

1.3. Data processing outside the EEA

Insofar as we transfer data to service providers or other third parties outside the EEA, the security of the data during the transfer is guaranteed by adequacy decisions of the EU Commission, insofar as they exist (e.g. for Canada and Israel) (Art. 45 para. 3 DSGVO).

If no adequacy decision exists (e.g. for the USA), the legal basis for the data transfer is usually, i.e. unless we indicate otherwise, standard contractual clauses. These are a set of rules adopted by the EU Commission and are part of the contract with the respective third party. According to Art. 46 (2) lit. b DSGVO, they ensure the security of the data transfer. Many of the providers have given contractual guarantees that go beyond the standard contractual clauses to protect the data. These include, for example, guarantees regarding the encryption of data or regarding an obligation on the part of the third party to notify data subjects if law enforcement agencies wish to access data.

The transfer of data to third parties in the United Kingdom of Great Britain and Northern Ireland is currently based on the transitional arrangement in the trade and cooperation agreement between the European Union and the United Kingdom.

1.4. Data deletion and storage duration

Unless expressly stated within the scope of this data protection declaration, the data stored by us will be deleted as soon as it is no longer required for its intended purpose and the deletion does not conflict with any statutory retention obligations. If the data is not deleted because it is required for other and legally permissible purposes, its processing will be restricted, i.e. the data will be blocked and not processed for other purposes. This applies, for example, to data that we must retain for reasons of commercial or tax law.

Data subjects also have the right to complain to a data protection supervisory authority about the processing of their personal data.

1.6. Obligation to provide data

In the context of a business relationship or other relationship, customers, interested parties or third parties only have to provide us with the personal data that is required for the establishment, implementation and termination of the business relationship or other relationship or which we are legally obliged to collect. Without this data, we will usually have to refuse to conclude a contract or provide a service or will no longer be able to perform an existing contract or other relationship.

1.7. No automatic decision making in individual cases

The legal basis for the processing is our legitimate interest (Art. 6 para. 1 p. 1 lit. f DSGVO) to answer inquiries directed to us. We delete the data accruing in this context after storage is no longer necessary or restrict processing if there are legal retention obligations. Raus operates an opt-in email policy. When you contact Raus or make a booking using your email address, you will receive communications from Raus in connection with your booking. At the time of booking, you will have the opportunity to opt-in to our marketing mailing list. 2. Newsletter

We reserve the right to inform customers who have already used services from us or purchased goods from time to time by e-mail or other means electronically about our offers, if they have not objected to this. The legal basis for this data processing is Art. 6 para. 1 p. 1 lit. f DSGVO. Our legitimate interest lies in direct advertising (recital 47 DSGVO). Customers can object to the use of their e-mail address for advertising purposes at any time without incurring additional costs, for example via the link at the end of each e-mail or by sending an e-mail to our above-mentioned e-mail address.

Based on the consent of the recipients (Art. 6 para. 1 p. 1 lit. a DSGVO), we also measure the opening and click-through rate of our newsletters.

We send newsletters using Mailchimp from The Rocket Science Group, LLC, 675 Ponce de Leon Ave NE Suite 5000, Atlanta, GA 30308 USA (Mailchimp). This allows us to contact subscribers directly. In addition, we analyze your usage behavior in order to optimize our offer. The provider processes content, usage, meta/communication data and contact data in the process. 3. Data processing on our website

Each time our website is accessed, our system automatically collects data and information from the computer system of the calling computer.

The following data is collected:

3.1. Informational use of the website

During the informative use of the website, i.e. when site visitors do not separately transmit information to us, we collect the personal data that the browser transmits to our server in order to ensure the stability and security of our website. This is our legitimate interest, so that the legal basis of Art. 6 para. 1 p. 1 lit. f DSGVO applies. These data are:

  • Time zone difference from Greenwich Mean Time (GMT)
  • Content of the request (specific page)
  • Access status/HTTP status code
  • Amount of data transferred in each case
  • Website from which the request comes
  • Browser
  • Operating system and its interface
  • Language and version of the browser software.

This data is also stored in log files. They are deleted when their storage is no longer necessary.

3.2. Web hosting and provision of the website

Our website hosts on the basis of a contract processing agreement (Art. 28 DSGVO) with Netily Inc, 610 22nd Street Suite 315 San Francisco, CA 94107 United States. In doing so, the provider processes the personal data transmitted via the website, e.g. on content, usage, meta/communication data or contact data. It is our legitimate interest to provide a website, so that the legal basis for data processing is Art. 6 para. 1 p. 1 lit. f DSGVO. 3.3. Contact form

When contacting us via the contact form on our website, we store the data requested there and the content of the message. The legal basis for the processing is our legitimate interest in answering inquiries directed to us. The legal basis for the processing is therefore Art. 6 para. 1 p. 1 lit. f DSGVO. We delete the data accruing in this context after storage is no longer necessary or restrict processing if there are legal retention obligations.

3.4. Job ads

We publish vacancies that are available in our company on our website, on pages linked to the website or on third-party websites. The processing of the data provided as part of the application is carried out for the purpose of implementing the application process.

Insofar as this is necessary for our decision to establish an employment relationship, the legal basis is Art. 88 (1) DSGVO in conjunction with Section 26 (1) BDSG. We have marked the data required to carry out the application process accordingly or refer to them. If applicants do not provide this data, we cannot process the application. Further data is voluntary and not required for an application. If applicants provide further information, the basis is their consent (Art. 6 para. 1 p. 1 lit. a DSGVO).

We ask applicants to refrain from providing information on political opinions, religious beliefs and similarly sensitive data in their CV and cover letter. They are not required for an application. If applicants nevertheless provide such information, we cannot prevent their processing as part of the processing of the resume or cover letter. Their processing is then also based on the consent of the applicants (Art. 9(2)(a) DSGVO).

Finally, we process the applicants' data for further application procedures if they have given us their consent to do so. In this case, the legal basis is Art. 6 para. 1 p. 1 lit. a DSGVO. We pass on the applicants' data to the responsible employees in the HR department, to our order processors in the area of recruiting and to the employees otherwise involved in the application process.

If we enter into an employment relationship with the applicant following the application process, we delete the data only after the employment relationship has ended. Otherwise, we delete the data no later than six months after rejecting an applicant. If applicants have given us their consent to also use their data for further application procedures, we will not delete their data until one year after receipt of the application.

3.5. Offer of goods or services

We offer goods or services via our website. In the ordering process or shipping, we involve the service providers who receive only the personal data required in each case to provide a service. The processing of the data takes place for the performance of the contract concluded with the respective site visitor (Art. 6 para. 1 p. 1 lit. b DSGVO).

3.6. Payment service provider

For the processing of payments, we use payment processors who are themselves data controllers within the meaning of Art. 4 No. 7 DSGVO. Insofar as they receive data and payment data entered by us in the ordering process, we thereby fulfill the contract concluded with our customers (Art. 6 para. 1 p. 1 lit. b DSGVO). We primarily use the payment platform of Adyen N.V., Simon Carmiggeltstraat 6-50, 1011 DJ in Amsterdam, the Netherlands ("Adyen"). 3.7. Apaleo GmbH

We used the hotel management system of apaleo GmbH, Dachauer Str. 15A, 80335 Munich ("apaleo"). At Apaleo, for the use of the software of apps, the website and the online store in the context of the provision of services (hereinafter referred to as "services") - various types of data are collected that arise from the use of the services, some of which are provided by StayRaus GmbH as a user of the hotel management system and some of which are necessary for the use of the website. 3.8. UP Booking Engine

We use the booking tool UP Booking Engine of UP Hotel Agency, The Old Telephone Exchange, Albert Street, Rugby, England, CV21 2SA ("UP"). At UP, for the use of the software of apps, the website and the online store in the context of the provision of services (hereinafter referred to as "services") - various types of data are collected that arise from the use of the services, some of which are provided by StayRaus GmbH as a user of the booking tool and some of which are necessary for the use of the website. UP protects the personal data by taking all reasonable and necessary technical and organizational measures so that they are not accessible to unauthorized third parties. 3.9. HubSpot

We use the CRM tool of HubSpot Inc., 25 First Street, 2nd Floor Cambridge, MA 02141, United States ("HubSpot"). At HubSpot, for the use of the software of apps, the website and the online store in the context of the provision of services (hereinafter referred to as "services") - various types of data are collected that arise from the use of the services, some of which are provided by StayRaus GmbH as a user of the CRM tool and some of which are necessary for the use of the website. HubSpot protects the personal data by taking all reasonable and necessary technical and organizational measures so that they are not accessible to unauthorized third parties. 3.10. UpsellGuru

We use the upgrade tool of UpsellGuru GmbH, Unterm Hagen 35, 59939 Olsberg ("UpsellGuru"). UpsellGuru collects for the use of the software of apps, the website and the online store in the context of the provision of services (hereinafter referred to as "services") - various types of data that arise from the use of the services, some of which are provided by StayRaus GmbH as a user of the Upgrade Tool and some of which are necessary for the use of the website. 3.13. Hotjar

We use Hotjar Limited, Level 2, St Julians Business Centre, 3, Elia Zammit Street, St Julians STJ 1000, Malta, Europa („Hotjar”), in order to better understand our users’ needs and to optimize this service and experience. Hotjar is a technology service that helps us better understand our users’ experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain our service with user feedback. Hotjar uses cookies and other technologies to collect data on our users’ behavior and their devices. This includes a device's IP address (processed during your session and stored in a de-identified form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), and the preferred language used to display our website. Hotjar stores this information on our behalf in a pseudonymized user profile. Hotjar is contractually forbidden to sell any of the data collected on our behalf. 3.14. Third party tools

3.14.1. Google Analytics

If the site visitor has given consent to do so, we use Google Analytics, a web analytics service provided by Google Ireland Ltd, Gordon House, Barrow Street, D04 E5W5, Dublin, Ireland ("Google"), on the basis of a commission processing agreement (Art. 28 DSGVO). The service uses cookies. The cookies generate information about the use of the website by site visitors, including pages viewed, achievement of "website goals" (e.g. contact requests and newsletter sign-ups), behavior on the pages (for example, clicks, scrolling behavior and dwell time), the approximate location (country and city), the IP address of the page visitor (in shortened form, so that no unique assignment is possible), technical information such as browser, Internet provider, terminal device and screen resolution and source of origin of the visit (i.e., through which website or advertising medium a page visitor came to us). In doing so, pseudonymized usage profiles of site visitors can be created from the data. Google does not merge the IP address transmitted by the site visitor's browser with other data. The security of the data transfer to the USA is guaranteed by standard data protection clauses adopted by the EU Commission (Art. 46 para. 2 lit. c DSGVO), which we have agreed with Google.

3.14.2. Google Ads (former Adwords)

For the placement of advertisements, we use the Google AdWords tool of the company Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, ("Google") on the basis of an order processing agreement. The tool collects and transmits cookies with usage data, especially which pages have been visited, which elements have been clicked on, device and browser information, IP address, operating system, data about the displayed advertisements and data from advertising partners, in particular pseudonymized user IDs to the provider of the tool. As far as legally required, we have obtained your consent pursuant to Art. 6 (1) lit. a DSGVO for the processing of your data as described above. 3.14.3. Google Marketing Platform

We use marketing and remarketing services in Google's marketing platform on our website on the basis of an order processing agreement (Art. 28 DSGVO). These services allow us to display advertisements in a more targeted manner in order to present page visitors with ads that are tailored to their interests. 3.14.4. Facebook's visitor action pixel

We use the "visitor action pixel" of Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland ("Facebook") on our website on the basis of a commission processing agreement (Art. 28 DSGVO). With the help of the visitor action pixel, we can track the behavior of site visitors after they have been redirected to our website by clicking on a Facebook ad (so-called "conversion"). We can also use this method to record the effectiveness of the Facebook ads for statistical and market research purposes.

The data collected in this way is anonymous for us, which means that we do not see the personal data of individual users. However, this data is stored and processed by Facebook. 3.14.5. Facebook Custom Audiences

We use the "Custom Audiences" service of Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland ("Facebook") on our website on the basis of a commission processing agreement (Art. 28 DSGVO). The offer allows us to divide visitors to your website into groups based on the actions they have taken on the website. These groups are called Custom Audiences. Based on this Custom Audience, we can serve ads to other users of Facebook who meet the criteria of that audience. The service thus further processes the data already collected through other actions, such as the Visitor Pixel.
